Effective Date: May 1, 2023

Jitsu Delivery Partners (“Seattle Delivery Partners” or “you”) who have performed delivery services in Seattle within the last 90 days are entitled to Paid Sick & Paid Safe Time (“PSST”) as outlined in Seattle’s App-Based Worker Paid Sick and Safe Time Ordinance (the “Ordinance”).

Seattle Delivery Partners will accrue one day (equivalent to a 24-hour period) of PSST for every 30 days the Seattle Delivery Partner accepts and delivers an Jitsu route that is picked up or delivered in Seattle.

The amount of PSST compensation is based on your “average daily compensation.” This average is recalculated each month, and is  equal to the daily average compensation you earned for each day you have performed services, at least partially in Seattle, during a trailing 52 week period prior to requesting PSST.

Seattle Delivery Partners will receive following information in their weekly paystub: the current rate of average daily compensation for use of PSST, and an updated amount of accrued PSST since the last paystub, reduced by the amount of PSST used since the last paystub, as well as the amount of unused, available PSST.

Seattle Delivery Partners who have worked in Seattle at least once in the past 90 calendar days can use their accrued PSST for several reasons outlined in the Ordinance, including:

  • Sick Time - Personal. For a personal mental or physical illness, injury, or health condition; to accommodate your need for medical diagnosis, care, or treatment of a mental or physical illness, injury, or health condition; or need for preventive medical care.
  • Sick Time - Care of Family Members. For care of a family member with a mental or physical illness, injury, or health condition; care of a family member who needs medical diagnosis, care, or treatment of a mental or physical illness, injury, or health condition; or care of a family member who needs preventive medical care.
  • Safe Time - Jitsu Suspension of Services by Order. If Jitsu has suspended or otherwise discontinued operations by order of a public official, for any health-related reason, to limit exposure to an infectious agent, biological toxin, or hazardous material.
  • Safe Time - Jitsu Suspension or Reduction of Services for Health / Safety Reasons. If Jitsu has reduced, suspended, or otherwise discontinued operations for any health- or safety-related reason.
  • Safe Time - School or Childcare Closure. If the Seattle Delivery Partner’s family member's school or place of care has been closed.
  • Safe Time - Domestic Violence Related Reasons. Any of the following reasons related to domestic violence, sexual assault, or stalking of you or your family member:  seeking legal or law enforcement assistance or remedies, including but not limited to, preparing for or participating in civil or criminal legal proceedings; healthcare treatment; services from a domestic violence shelter, rape crisis center, or other social services program; mental health counseling; or safety planning, temporary or permanent relocation, or other steps taken to increase the safety of you or your family hor household member from future domestic violence, sexual assault, or stalking.

Seattle Delivery Partners must use this form to submit requests for use of PSST time. This will be reviewed by Jitsu and if approved, PSST compensation will be made available in the following scheduled pay cycle.

If the Seattle Delivery Partner has used more than 3 consecutive days of PSST, Jitsu may request that the Seattle Delivery Partner provide reasonable verification that he/she is using the PSST for an authorized purpose consistent with the Ordinance. Verification may include documentation signed by a health care provider indicating the use of PSST was necessary, but will not require disclosing the nature of the illness, injury, health condition, or preventive care. Seattle Delivery Partners will be provided with at least 10 calendar days following the first day of the use of PSST to provide any such verification. The Seattle Delivery Partner has the right to provide an oral or written explanation that they used PSST for an authorized purpose if standard verification methods such as a note from a healthcare provider would create an unreasonable burden or expense. If the Seattle Delivery Partner provides such an explanation, Jitsu will respond within 10 days and provide alternatives for the Seattle Delivery Partner to meet the verification requirement in a manner that does not impose an unreasonable burden or expense.

Seattle Delivery Partners can use PSST in one-day (i.e. one 24-hour period) increments, starting from 12:00am and ending at 11:59pm, local standard time. The day increment of PSST use will begin on the day the Seattle Delivery Partner indicates their use of PSST. The Seattle Delivery Partner may still book delivery opportunities during this time period, however, it is expected that the Seattle Delivery Partner will not perform any deliveries during their requested PSST period. If a Seattle Delivery Partner performs deliveries during their requested PSST period, Jitsu may determine that the Seattle Delivery Partner did not use the PSST for an authorized purpose, and Jitsu may withhold compensation for the requested day of PSST.  If Jitsu does so, it will provide you with written notice of its decision and an opportunity to contest the withholding of compensation.

Jitsu will use the year period from Jan 1 - Dec 31 for purposes of carrying over accrued PSST. Seattle Delivery Partners will be able to carry over to the next year up to 9 days of accrued but unused PSST consistent with the Ordinance. Any additional accrued but unused PSST will be forfeited.

You will be protected from retaliation for exercising in good faith your rights protected by the Ordinance. The Notice of Rights published by the Seattle Office of Labor Standards on the Ordinance is available at: App-Based Worker Paid Sick and Safe Time (seattle.gov).
